Description

Citing that multiple voices and actors have something valuable to contribute to understanding a multi-faceted contest of rights and obligations such as the Israeli-Palestinian dispute, Barnidge aims to advance understanding of the international law of negotiation and use it as a framework for assessing the Israeli-Palestinian dispute. In brief, chapter 2 stresses the importance of the law’s intersection with developments in Palestine between the First and Second World Wars. Chapter 3 opens to the devastation of the 1948 War. Chapter 4 explores the years after 1973, with the gradual emergence of a specifically bilateral negotiation imperative between Israel and the PLO. Chapter 5 looks at the relationship between negotiation and other means of dispute settlement. Chapter 6 examines the precise nature of the rights and obligations that adhered to Israel and the PLO between September, 1993, and the events of autumn 2011 and autumn 2012. Chapter 7 concludes that Israel and the PLO will have to forego certain claims and cure certain breaches if they are to reach a final settlement. Distributed in the US by ISBS.
