In this casebook, Dycus (law, Vermont Law School) details recent developments in law and policy concerning counterterrorism, part of the larger field of national security law. The book covers defining terrorism, attacking terrorists abroad, detecting and preventing terrorism with surveillance and screening, detention and treatment of terrorist suspects in custody, methods for adjudicating terrorist suspects, legal problems arising from planning for and responding to attacks, and the military's domestic role in counterterrorism. A final section examines the legal bases for imposing sanctions against terrorists and their sponsors outside the criminal justice system. Questions are included for discussion or assignments. While the book is comprehensive and self-contained, it is not intended to function as a "how-to" course, but rather as a collection of resources to help students and citizens reflect on how to protect national security under the rule of law; whether civil rights and liberties must be traded for security, and what roles each of the three branches of government should play in making these decisions and trade-offs.
