Retaining the goal of presenting a casebook that covers both doctrinal and theoretical themes of civil procedure in the United States in a manageable length, the authors (professors of law from Duke U., Vanderbilt U., and U. of Notre Dame) have updated this third edition in accordance with recent Supreme Court and lower court jurisprudence, Congressional action on subject matter jurisdiction and venue of the federal courts, and significant amendments to the Federal Rules of Civil Procedure. They incorporate seven new Supreme Court opinions and eight new lower federal court decisions as principal cases and incorporate discussions and citations of numerous others into their notes. This 750 page book is structured so it can be taught quickly but at a high level. The tightly edited cases capture students’ interest while teaching the material well. Notes are short but intellectually challenging. The book has enough materials to cover topics basically or in depth. The casebook introduces students to the themes running through civil procedure: efficiency and fairness, advantages and disadvantages of the adversarial system, real-life litigation strategies, and issues of federalism and separation of powers. The teacher's manual suggests strategies for teaching the materials and different approaches for credit allocations and teacher preferences. For more information and additional teaching materials, visit the companion site.
